Welcome to CaddyPro AI (the "App"), developed and operated by CaddyPro Golf ("we," "our," or "us"). By downloading, installing, or using the App, you agree to comply with and be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, do not use the App.
1. Acceptance of Terms
By using CaddyPro AI, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as any policies referenced herein, including our Privacy Policy.
2. Use of the App
The App is designed to simulate golf swings, provide AI-assisted analysis, and process images for training purposes.
You agree to use the App only for lawful purposes. You may not use the App to:
Engage in any illegal or fraudulent activity
Access, copy, or distribute content without authorization
Reverse engineer, decompile, or modify the App
Introduce viruses or harmful code
3. User Accounts
Some features may require you to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate and up-to-date information and to update it as necessary.
4. Intellectual Property
All content, software, AI models, images, and graphics in the App are owned by us or our licensors. You may not copy, modify, distribute, sell, or create derivative works without our express written permission.
5. User Content
Any images, data, or other content you submit to the App ("User Content") remains your property. By submitting User Content, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and process the content solely to provide and improve the App.
You are solely responsible for the User Content you upload. You must not upload content that is illegal, offensive, or infringes the rights of others.
6. Privacy
Your use of the App is subject to our Privacy Policy, which explains how we collect, use, and protect your data.
7. Disclaimers
The App is provided "as is" and for entertainment and training purposes only. We do not guarantee the accuracy, completeness, or reliability of any AI-generated suggestions or results. You assume all risk of using the App, including any decisions made based on its outputs.
CaddyPro AI is not a substitute for professional golf instruction. We recommend consulting with certified golf professionals for personalized coaching and technique improvement.
8. Limitation of Liability
To the maximum extent permitted by law, we are not liable for any direct, indirect, incidental, consequential, or punitive damages arising from your use of the App. This includes damages related to loss of data, income, business opportunities, or injury sustained while using the App.
9. Subscription and Payments
If you purchase a subscription or paid features within the App, you agree to pay all applicable fees. Subscriptions automatically renew unless cancelled before the renewal date. Refunds are handled in accordance with the app store policies (Apple App Store or Google Play Store) through which you made your purchase.
10. Termination
We may suspend or terminate your access to the App at any time for violations of these Terms or for any reason at our discretion. You may also terminate your account at any time by discontinuing use of the App and deleting your account through the App settings.
Sections relating to Intellectual Property, Disclaimers, and Limitation of Liability survive termination.
11. Governing Law
These Terms are governed by the laws of New Zealand, without regard to conflict of law principles. Any disputes arising out of or relating to these Terms shall be resolved in the courts of New Zealand.
12. Changes to Terms
We may update these Terms from time to time. The latest version will be posted in the App or on our website at caddypro.golf. Continued use of the App constitutes acceptance of the updated Terms. We will notify users of material changes through the App or via email.
